Terms of Service

This is the agreement between you and Reality. It is also the end user licence agreement (EULA) for the Reality app. By creating an account you agree to it.

Read these three things if you read nothing else.

  1. Reality has zero tolerance for objectionable content and abusive users. Objectionable content is removed and the account that posted it is terminated. We aim to act on every report within 24 hours.
  2. We do not run criminal background checks or verify anyone's identity. You are responsible for your own safety when you talk to or meet someone. Read the Safety Guide.
  3. Deleting your account does not cancel your subscription. Only Apple or Google can do that, in your store account settings.

1. This agreement

Reality is operated by Jordan Epifania, trading as Reality, ABN 69 356 652 795, a sole trader in New South Wales, Australia. "We", "us" and "Reality" mean that operator. "You" means you.

These Terms, together with our Community Guidelines and Privacy Policy, form the whole agreement between you and us. The Community Guidelines are part of these Terms.

This document is also the EULA for the Reality application. It replaces any default end user licence agreement offered by Apple or Google.

By creating an account, or by using Reality, you agree to these Terms. If you do not agree, do not use Reality.

2. Who can use Reality

By using Reality you represent and warrant that:

If any of these stops being true, you must stop using Reality and close your account.

Reality is currently offered only in parts of Australia. We may add or remove areas at any time.

4. Rules of use and zero tolerance

Reality has zero tolerance for objectionable content and abusive users. Content that breaches these Terms or our Community Guidelines will be removed, and the account of the user who posted it will be terminated. Serious breaches result in a permanent ban with no warning and no refund.

You must not post, send, or do any of the following on Reality. This list is not exhaustive; the full list is in our Community Guidelines, which form part of these Terms.

You must also comply with all applicable laws when using Reality, and you must treat other people the way you would want to be treated. This is a service for meeting people; it stops working the moment it stops being safe.

5. Reporting, blocking and what we do about it

5.1 The tools

You can report and block any user from every place they appear in the app — the swipe deck, their profile, your likes, your matches, a conversation, and a message request. Blocking removes them from your experience immediately and silently; they are not told. Reporting is confidential.

You can also report a user you have already declined, and you can block someone without reporting them.

5.2 Our commitment

We aim to review every report and act on objectionable content within 24 hours, including by removing the content and terminating the account of the user who posted it. Some reports need more investigation than others, but every genuine report is reviewed and acted on.

5.3 Automated filtering

We filter objectionable material before it reaches other users: every photo is scanned automatically for explicit and violent content before it can appear on a profile, borderline photos are held for human review, and text you write is checked against a prohibited-content filter.

5.4 Child sexual exploitation

We report suspected child sexual exploitation material to the Australian Centre to Counter Child Exploitation (ACCCE), and to any other authority the circumstances require. We preserve and disclose the material and the associated account data to them. This is not limited by any other provision of these Terms or our Privacy Policy, and we will not notify the account holder first.

5.5 Other reporting routes

You can also report seriously harmful online content to the Australian eSafety Commissioner at esafety.gov.au/report. If you are in immediate danger, call 000.

6. What we let you do

We grant you a personal, limited, non-exclusive, revocable, non-transferable licence to install and use one copy of the Reality app on devices you own or control, for your own non-commercial use, in accordance with these Terms and the usage rules of the store you got it from.

We keep all rights not expressly granted. You must not copy, modify, distribute, sell, lease, decompile or reverse-engineer any part of Reality, or attempt to extract its source code, except where the law says you may despite this restriction.

7. Your content, and what you let us do with it

"Your Content" means the photos, text, messages and anything else you put on Reality. You keep ownership of it.

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, reformat, display and transmit Your Content for the sole purpose of operating, providing, securing and improving Reality — for example, showing your profile to other users, generating thumbnails, and moderating content for safety.

This licence:

You promise that you own or have the right to post Your Content, and that it does not breach anyone else's rights or any law.

To the extent permitted by the Copyright Act 1968 (Cth), you consent to us doing anything described in this section that would otherwise infringe your moral rights, including using Your Content without identifying you as its author and making the technical changes described above.

We may remove Your Content at any time if we reasonably believe it breaches these Terms, the Community Guidelines, or the law.

8. Purchases and subscriptions

Reality is free to use. Some features require a paid subscription or a one-off purchase.

Refunds. Because Apple and Google process payment, refund requests generally go to them. Purchases are otherwise not refundable and there is no credit for a partly used period — except where you are entitled to a remedy under the Australian Consumer Law or any other law that applies to you. See section 13. If you think something has gone wrong with a purchase, email us and we will help.

9. Suspension, banning and closing your account

You can close your account at any time from inside the app: Profile → Settings → Delete Account. You have 30 days to change your mind. See our Privacy Policy for exactly what happens to your data.

We may suspend, restrict or terminate your account where we reasonably believe you have breached these Terms or the Community Guidelines, where we are required to by law, or where it is necessary to protect the safety of another person.

10. No background or identity checks

Reality does not conduct criminal background checks, sex offender register checks, or identity verification on its users.

We make no representation or warranty about the conduct, identity, age, health, intentions, honesty, or legitimacy of any user. We do not vouch for anyone.

You are solely responsible for your interactions with other users, online and in person. Our photo scanning, reporting and blocking tools reduce risk; they do not eliminate it and they are not a substitute for your own judgement.

Please read the Safety Guide before you meet anyone. Always tell someone where you are going, meet in public the first time, and arrange your own transport.

Reality is not responsible for the conduct of any user, whether on the app or off it. Nothing in this section limits any right you have under the Australian Consumer Law — see section 13.

11. Privacy

Our Privacy Policy explains what we collect, why, who we share it with, and how long we keep it. It forms part of your agreement with us.

12. Availability and changes to the service

We will try to keep Reality available and working, but we cannot promise it will always be available, uninterrupted, or free of faults. We may add, change or remove features, and we may suspend the service for maintenance.

If we permanently discontinue Reality, we will give you reasonable notice and refund the unused portion of any subscription.

13. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee, warranty, term or condition that is implied or imposed by the Australian Consumer Law or any other law and that cannot lawfully be excluded, restricted or modified.

If we fail to meet a consumer guarantee, you may be entitled to a remedy — including, for a major failure, cancelling your subscription and getting a refund, and compensation for any other reasonably foreseeable loss or damage.

Sections 14 and 15 apply only to the extent the law allows, and are subject to this section.

14. Disclaimers and limits on our liability

Subject to section 13, and to the maximum extent permitted by law:

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

15. Your responsibility to us

You agree to compensate us for any loss, cost or claim we reasonably incur that arises directly from your breach of these Terms, your unlawful conduct, or your infringement of someone else's rights. This does not apply to the extent the loss was caused by us.

If you believe something on Reality infringes your copyright, email support@realitydating.com.au with "Copyright complaint" in the subject line and include: what the work is, where on Reality it appears, your contact details, and a statement that you believe in good faith that the use is not authorised and that the information in your notice is accurate.

We will investigate and remove infringing material. We may terminate the accounts of repeat infringers.

17. Apple and Google

These acknowledgements apply where you obtained Reality from the Apple App Store:

Where you obtained Reality from Google Play, your use is also subject to the Google Play Terms of Service, and this agreement is between you and us, not Google.

18. If something goes wrong between us

Please email support@realitydating.com.au first. Most things are fixable and we would rather fix them.

If we cannot resolve it, both of us agree to try in good faith for 30 days from the date one of us notifies the other of a dispute, before starting proceedings.

These Terms are governed by the laws of New South Wales, Australia. Both of us submit to the non-exclusive jurisdiction of the courts of New South Wales.

Nothing in this section stops you from: bringing a claim in a small claims tribunal or court; complaining to the Office of the Australian Information Commissioner, the eSafety Commissioner, the ACCC, or your state or territory fair trading body; or exercising any other right you have under the law. There is no compulsory arbitration and no waiver of any right to participate in group proceedings.

19. Changes to these Terms

We may update these Terms. If a change materially and adversely affects you, we will give you notice in the app or by notification before it takes effect, and you may close your account before then. If you do, and you have paid for a subscription you can no longer use, we will refund the unused portion.

Continuing to use Reality after a change takes effect means you accept the updated Terms. We will always update the date at the top of this page.

We may change the Community Guidelines at any time to respond to new kinds of harmful behaviour, and those changes take effect when published.

We aim to respond to all support enquiries within 2 business days, and to reports of objectionable content within 24 hours.
